Settlement Funding

BACKGROUND

In March 2020, Ohio Governor Mike DeWine and Attorney General Dave Yost announced that local governments representing more than two-thirds of the state’s population signed on to the OneOhio plan in order to jointly approach opioid settlement negotiations and litigation. The OneOhio plan provides a mechanism for the distribution of opioid settlement funds and outlines how those funds can be used. Specifically:

  • 55% of the funding goes directly to the OneOhio Recovery Foundation to develop and oversee the funding of short-term and long-term planning and supports that local communities need to continue to address this crisis.

  • 30% of the funding goes directly to townships, villages, cities and counties in Ohio to support community recovery and address the immediate needs of residents. These direct payments to local governments are separate and distinct from those managed by the Foundation.

  • 15% goes to the State of Ohio to be used to leverage statewide buying power to offer prevention, treatment and recovery support services. Direct payments to the state are separate and distinct from those managed by the Foundation.

In July 2021, the Distributor settlement (AmerisourceBergen, Cardinal Health & McKesson) was the first national settlement agreed to under the terms outlined in the OneOhio plan, and the OneOhio Memorandum of Understanding was formally adopted in legal settlement documents. Since July 2021, additional national opioid settlements and one bankruptcy (NOAT II/Mallinckrodt) have been finalized using the process established under the OneOhio plan, all of which have different payment schedules and terms. Additional legal settlements are anticipated.


PAYMENTS RECEIVED BY THE FOUNDATION

As of September 2024, the OneOhio Recovery Foundation has received $223.4M from the national opioid settlements and NOAT II (Mallinckrodt bankruptcy). Those payments include:

  • $3.6M from the Mallinckrodt bankruptcy (NOAT II) in March 2023

  • $34.6M from the Distributor settlement (Years 1-2) in March 2023

  • $20.5M from the Janssen/J&J settlement (Years 1-2) in March 2023

  • $10.5M from the Janssen/J&J settlement (Year 3) in June 2023

  • $17.2M from the Distributor settlement (Year 3) in August 2023

  • $4.3M from the Mallinckrodt bankruptcy (NOAT II) in November 2023

  • $3.2M from the Distributor settlement (Year 18 Prepayment) in March 2024

  • $16.5M from the Janssen/J&J settlement (Year 4) in June 2024

  • $21.6M from the Distributor settlement (Year 4) in July 2024

  • $52.6M from the Walmart settlement (Multi-Year) in July 2024

  • $13.8M from the Walgreens settlement (Years 1-2) in July 2024

  • $12.7M from the CVS settlement (Years 1-2) in July 2024

  • $12.3M from the Allergan/Teva settlement (Year 1) in July 2024

We encourage members of the public and media to review the Foundation’s financial reports for the latest updates. All financial reports are provided during the Foundation’s public Board of Directors meetings and in the corresponding meeting packets.

NOTE: Payments to the OneOhio Recovery Foundation outlined above do not include direct payments to the State of Ohio or local governments. Additionally, the OneOhio MOU calls for 11.05% of the settlement amount to go into a Local Government Fee Fund (LGFF), which is split between the Foundation (55%) and Local Government (30%) shares.  Actual OneOhio payments received take this LGFF allocation into account.

While the OneOhio Recovery Foundation has no involvement in the 30 percent payments made directly to local governments, nor the 15 percent payments made directly to the State of Ohio, the Foundation is committed to helping all Ohioans better understand the opioid settlement process.
